1. Overview

Welcome to Houndra. These Terms of Service (“Terms”) govern your use of our website and your purchase of products from Houndra.

Throughout these Terms, “Houndra”, “we”, “us” and “our” refer to the operator of this store. Our online store is hosted by Shopify, which provides the e-commerce platform that enables us to offer our products to you.

By accessing our website or placing an order, you agree to these Terms, together with our Privacy Policy, Return & Refund Policy and Shipping Policy.

Nothing in these Terms affects or limits any statutory rights that you may have under applicable consumer law.

2. Our Products

We take reasonable care to ensure that product descriptions, images, specifications and other information displayed on our website are accurate.

Product colours and appearance may vary slightly depending on your device, screen settings and other factors.

We may update product information or discontinue products where reasonably necessary. Any such change will not affect an order already accepted by us unless agreed with you or otherwise permitted by law.

All goods supplied by Houndra are subject to your statutory consumer rights, including applicable rights relating to goods that are faulty, damaged, not as described or otherwise not in conformity with the contract.

3. Orders and Contract Formation

By placing an order, you are offering to purchase the products in your order.

After you place an order, you will receive an electronic acknowledgement. Acceptance of your order occurs when we confirm that the order has been accepted or processed for fulfilment.

We may refuse or cancel an order where there is a legitimate reason to do so, including where a product is unavailable, there is an obvious pricing or description error, payment cannot be authorised, fraud is reasonably suspected, or we are unable to fulfil the order.

If we cancel an order after payment has been taken, we will refund the applicable amount paid for the cancelled order.

Nothing in this section restricts any statutory cancellation or refund rights available to you.

4. Prices, Taxes and Payment

Prices displayed to UK consumers are shown in British pounds sterling (GBP).

The total price payable, including applicable taxes and any mandatory charges that can reasonably be calculated in advance, will be displayed before you place your order.

Any applicable delivery charge will also be disclosed before you complete your purchase. Where we offer free delivery, no separate delivery charge will be added for that delivery method.

You must provide accurate and complete payment, billing and contact information when placing an order.

Payment methods available to you will be displayed during checkout. Payments are processed through the payment providers made available through our store.

5. Shipping and Delivery

We deliver to the locations made available through our checkout.

Available delivery methods, estimated delivery times and any applicable delivery costs will be displayed on our website or during checkout.

Delivery estimates are provided in good faith. Delays may occasionally occur because of carriers, customs processing or circumstances outside our reasonable control. Where a delay occurs, your statutory rights remain unaffected.

Unless otherwise agreed with you or provided by applicable law, we will arrange for the goods to be delivered without undue delay and within the legally applicable period.

The goods remain at our risk until they come into your physical possession, or into the physical possession of a person identified by you to receive them, except where applicable law provides otherwise.

6. Cancellations, Returns and Refunds

If you are a consumer purchasing online, you may have a statutory right to cancel your order without giving a reason.

For eligible purchases, you may notify us that you wish to cancel within 14 days of receiving your goods. After notifying us, you must return the goods within 14 days.

The conditions and procedures for cancellations, returns, damaged or defective products and refunds are explained in our Return & Refund Policy.

Nothing in these Terms or our Return & Refund Policy limits your statutory rights in relation to faulty, damaged, incorrect or not-as-described goods.

7. Product Availability

All orders are subject to product availability.

If a product becomes unavailable after you place an order, we will contact you where necessary. If we cannot supply the product and your order is cancelled, any applicable amount already paid for that product will be refunded.

8. Accounts and Information

You are responsible for ensuring that information you provide to us is accurate and current.

If you create or use a customer account, you are responsible for maintaining the confidentiality and security of your account credentials.

You must notify us if you become aware of unauthorised use of your account.

9. Acceptable Use

You may use our website only for lawful purposes.

You must not misuse the website, attempt to interfere with its security or operation, introduce malicious software, use the website fraudulently, infringe the rights of others, or use the website in violation of applicable law.

We may restrict access to the website where reasonably necessary to protect Houndra, our customers, Shopify or other users from fraud, abuse, security threats or unlawful activity.

Unless otherwise stated, the content made available through the Houndra website, including Houndra branding, logos, text, graphics and original website content, is owned by or licensed to Houndra and is protected by applicable intellectual property laws.

Third-party trademarks, content and other intellectual property remain the property of their respective owners.

You may use the website for your personal, non-commercial use. You may not reproduce, distribute, modify or commercially exploit protected Houndra content without permission, except where permitted by law.

11. Third-Party Services and Links

Our website may use or link to services operated by third parties, including payment providers, delivery providers and other technology services.

Where you access a third-party website or service, that third party may apply its own terms and privacy practices.

Nothing in this section excludes any responsibility that Houndra has to you under applicable consumer law in connection with products purchased directly from Houndra.

12. Shopify

Our store is hosted by Shopify, which provides the e-commerce technology used to operate the website.

Purchases made through the Houndra store are made from Houndra, not from Shopify. Shopify is not the seller of the products offered by Houndra.

13. Privacy

Our collection and use of personal information is described in our Privacy Policy.

Shopify and other service providers may also process personal information as necessary to provide the services used to operate our store, subject to applicable data protection requirements.

14. Reviews and User Content

If you submit a review, feedback or other content to us, you confirm that you have the right to provide that content and that it is not unlawful, misleading, abusive or infringing of another person's rights.

You grant Houndra permission to use, reproduce and display content that you voluntarily submit to us for the purposes of operating, improving and promoting our business, subject to applicable law.

We may moderate or remove user content where reasonably necessary, including where it is unlawful, fraudulent, misleading, abusive or otherwise inappropriate.

15. Errors and Website Information

We take reasonable care to keep information on our website accurate and up to date.

If we discover an obvious error relating to pricing, availability, product information or other material information, we may correct it.

If an error materially affects an order you have already placed, we will contact you where appropriate and will not use this provision to remove rights you have under applicable consumer law.

Nothing in these Terms excludes or limits liability where it would be unlawful to do so.

In particular, nothing in these Terms excludes or limits your statutory rights relating to goods, including rights relating to goods that are faulty, damaged, not as described or otherwise not in conformity with the contract.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot legally be excluded or limited.

To the extent permitted by law, we are not responsible for losses that were not reasonably foreseeable when the contract was formed or for losses arising from circumstances outside our reasonable control, except where applicable law provides otherwise.

17. Changes to These Terms

We may update these Terms from time to time to reflect changes to our business, services, website or legal requirements.

The version applicable to your purchase will generally be the version in effect when your order was placed. Changes made afterwards will not retrospectively remove rights that you already have.

The latest version will be made available on our website with an updated revision date.

18. Severability

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be treated as modified or removed only to the extent necessary, and the remaining provisions will continue to apply.

19. Governing Law and Consumer Rights

These Terms are governed by applicable law.

If you are a consumer, nothing in these Terms deprives you of any mandatory rights or protections available to you under the law that applies to you, including any mandatory rights relating to where legal proceedings may be brought.
